  • Presentation regarding In re Allard, 1 ABR 47 (Bankr. D. Alaska 1990) - Alaska Bar Association Bankruptcy Section Meeting, January 25, 2011. In Allard, the court permitted an unsecured deficiency claim to be asserted in a Chapter 7 bankruptcy case notwithstanding the provisions of Alaska's anti-deficiency statute, AS 34.20.100, where a secured creditor foreclosed upon real property non-judicially post-petition. The viability of Allard has risen in an increasing number of recent bankruptcy cases in light of declining property values.
