Kelly Rutherford's kids returned to Monaco

Alaska parents who are going through a divorce may be interested to learn that actress Kelly Rutherford was ordered to return her kids to their father in Monaco on Aug. 11. The ruling was made at Manhattan Supreme Court and her 6-year-old girl and 8-year-old boy were immediately taken to the airport by their paternal grandmother.

Rutherford and her ex-husband were divorced in 2008. Although they initially shared custody, the ex-husband had his U.S. visa revoked in 2013. A judge ordered the children to live with their father in Monaco while giving Rutherford visitation. Rutherford stated that she had traveled to Monaco more than 70 times to visit with her children.

In July, she attempted to get custody of the children from a California judge. Part of the problem is that Rutherford has had to divide her time between living in New York and Los Angeles. Although she could potentially get more work in Los Angeles, the flights were less expensive and shorter from New York. Following this incident, the ex-husband stated that Rutherford had abducted the children when she refused to send them back on Aug. 7, as was ordered.

While some parents can come to a quick agreement regarding where the children will live following a divorce, other parents find it much more difficult. For example, if one parent lives out of state or out of the country, determining where the children will live and how visitation will be handled can cause problems. If there is a major child custody dispute, a family law attorney can potentially demonstrate why it would be in the children's best interest to live with one parent and not the other. The attorney may also help negotiate a visitation schedule that works for everyone.
